There is no benefit in winning the battle but losing the war; I detail legal costs, compare them to amount of damages that may be recovered or, for defendant-client, amount of damages that may be avoided. Does client have lasting power for an often unpleasant stressful fight of 2 years or more? In time, initial gusto, determination often wane. Up front, need to ascertain ability to fund, time-competing obligations (work, family), importance of lawsuit, understand risks.
